Prepared in accordance with Section 51 of the Promotion of Access to Information Act, No 2 of 2000 ("PAIA"), in respect of AquaCheck (Pty) Ltd, Registration No. 2002/015316/07.

Introduction

AquaCheck (Proprietary) Limited, trading as AquaCheck, conducts business as a manufacturer of soil moisture and management equipment. PAIA gives effect to the right of access to information held by public and private bodies, entrenched in the Bill of Rights in the Constitution of South Africa. This manual helps members of the public understand what records AquaCheck (Pty) Ltd holds and how to request access to them.

Categories of Records Held

The list below is a reference to help you frame a request. Access to these records may still be subject to the grounds of refusal set out later on this page.

  • Human Resources: HR policies and procedures, advertised posts, employee records, UIF/PAYE/SDL records, employment contracts, employment application forms
  • Clients: VAT records, quotations, invoices, distributor agreements, credit applications
  • Suppliers: Quotations, invoices, credit applications

Records are also kept in accordance with applicable legislation, including the Companies Act, the Income Tax Act, the Labour Relations Act, the Employment Equity Act, the Electronic Communications and Transactions Act, the Basic Conditions of Employment Act, the Broad-Based Black Economic Empowerment Act, the Consumer Protection Act, the Value Added Tax Act, and the Protection of Personal Information Act.

Processing of Personal Information

AquaCheck (Pty) Ltd processes personal information for record keeping, compliance, staff administration, service delivery, handling complaints, procurement, health and safety, access and premises security, product and service improvement, legal contractual purposes, and to transact with suppliers.

  • Customers/Clients: name, address, contact details, registration numbers, VAT numbers, identity numbers and bank details
  • Suppliers: names, registration number, VAT numbers, address, contact details, product details and bank details
  • Employees: address, qualifications, gender and race, banking details, tax numbers, identity numbers, contact details

Personal information may be supplied to payroll administrators, training providers, our clock-in system, administrators, verification agencies, the provident fund, auditors, information security service providers, and couriers for delivery. Some client contact and billing details may be transferred outside South Africa. AquaCheck (Pty) Ltd secures information through restricted, authenticated access, encrypted local and cloud backups, antivirus protection, and firewall intrusion detection/prevention systems.

Requesting Access to a Record

To request access to a record held by AquaCheck (Pty) Ltd, complete Form 2 (linked above) and submit it, together with the required request fee, to the Information Officer at the address or email given above. Your request must identify the record sought, your identity, the form of access required, and how you wish to be contacted. You must also state the right you are seeking to exercise or protect, and why the record is needed for that purpose. Proof of identity must be attached, and if you are requesting on behalf of someone else, proof of that authority must also be attached.

AquaCheck (Pty) Ltd will process a request within 30 days of receipt (extendable by a further 30 days in certain circumstances) and will notify you of the outcome, and of any fees payable, using Form 3 (linked above).

Fees

A request fee of R140.00 is payable by every requester before a request is processed. Further fees may apply for photocopies, printed copies, computer-readable copies, and the time reasonably required to search for and prepare a record (currently R145.00 per hour after the first hour, up to a maximum of R435.00), plus actual postage or electronic transfer costs. A deposit of one third of the estimated fee is payable if the search is expected to exceed six hours.

Grounds for Refusal of Access

AquaCheck (Pty) Ltd may refuse a request where access would involve the unreasonable disclosure of a third party's personal information, disclosure of trade secrets or confidential commercial, financial or technical information, information protected by an agreement or legal privilege, or AquaCheck (Pty) Ltd's own trade secrets, commercial interests, or copyright-protected material. Requests that are frivolous, vexatious, or that would involve an unreasonable diversion of resources will also be refused.

This manual is available at the premises of AquaCheck (Pty) Ltd and on this website. A copy of the Guide on how to use PAIA, issued by the Information Regulator, can be obtained from the Information Officer or from the Information Regulator's website.
